Consumatorii de servicii \u0219i produse financiare au ob\u021binut beneficii mai mari din negocierile cu b\u0103ncile \u0219i IFN-urile desf\u0103\u0219urate anul trecut \u00een cadrul <strong>Centrului de Solu\u021bionare Alternativ\u0103 a Litigiilor \u00een domeniul Bancar (CSALB). <\/strong>\u00cen 2023 s-au adresat CSALB cei mai mul\u021bi consumatori din ultimii 7 ani, iar b\u0103ncile au acceptat cu 15% mai multe cereri de negociere dec\u00e2t \u00een 2022. Valoarea beneficiilor ob\u021binute de consumatori \u00een urma negocierilor cu b\u0103ncile a dep\u0103\u0219it anul trecut 3,3 milioane de euro.<\/p>\n\n\n\n<p><strong>2.932 de cereri <\/strong>a primit CSALB \u00een anul 2023 de la consumatorii care au solicitat b\u0103ncilor (1.885 cereri) \u0219i IFN-urilor (1.047 cereri) intrarea \u00eentr-o negociere \u00een cadrul Centrului. \u00cencep\u00e2nd din anul 2016, CSALB a primit aproximativ 15.000 de cereri de negociere cu institu\u021biile de credit.<\/p>\n\n\n\n<p>\u00cen 2023 <strong>b\u0103ncile au acceptat cu 100 mai multe cereri trimise de consumatori <\/strong>dec\u00e2t \u00een 2022.Astfel, s-au format 754 de dosare de negociere cu b\u0103ncile \u0219i doar 4 cu IFN-urile. &nbsp;<\/p>\n\n\n\n<p>Doar \u00een 8 din 100 de negocieri p\u0103r\u021bile nu au acceptat solu\u021biile propuse de conciliatori \u0219i nu s-au \u00een\u021beles. Conciliatorii CSALB au avut, astfel<strong>, cel mai mare procent de eficien\u021b\u0103 a concilierii de la \u00eenfiin\u021barea CSALB (92%)<\/strong>.<\/p>\n\n\n\n<p><strong>Alte 555 de \u00een\u021belegeri<\/strong> \u00eentre consumatori \u0219i b\u0103nci\/IFN-uri s-au rezolvat amiabil, prin \u00een\u021belegere direct\u0103, dup\u0103 ce consumatorii au trimis cererile c\u0103tre CSALB. Majoritatea acestora erau probleme simple, care se puteau rezolva \u0219i f\u0103r\u0103 aportul unui conciliator al Centrului sau care nu \u021bineau de condi\u021bii ce puteau fi negociate (cum sunt cererile de \u0219tergere a \u00eenregistr\u0103rilor \u00een Biroul de Credit).<\/p>\n\n\n\n<p><strong>24 de zile a fost timpul mediu de negociere<\/strong> cu banca anul trecut. De\u0219i conform legii (OG 38\/2015) timpul maxim de g\u0103sire a unei solu\u021bii prin conciliere este de 90 de zile \u0219i poate dep\u0103\u0219i acest termen \u00een cazul negocierilor mai complicate, rapiditatea solu\u021bion\u0103rii alternative la instan\u021b\u0103 a crescut constant \u00een ultimii ani.<\/p>\n\n\n\n<p><strong>Cele mai rapide \u00een\u021belegeri <\/strong>au fost finalizate \u00een 2023 \u00eentr-o singur\u0103 zi(14 cazuri) sau \u00een dou\u0103 zile (37 cazuri). Au existat \u0219i 31 de negocieri mult mai dificile, care s-au \u00eencheiat dup\u0103 mai mult de 100 de zile. Conciliatorii care au solu\u021bionat negocierile cel mai rapid sunt: <strong>Roxana Must\u0103\u021bea <\/strong>(medie de 12 zile), <strong>Nela Petri\u0219or<\/strong> (medie de 14 zile), <strong>Septimiu Stoica \u0219i Ionu\u021b \u0218tefan <\/strong>(medie de 15 zile).<\/p>\n\n\n\n<p>Conciliatorii care au intermediat <strong>cele mai multe negocieri <\/strong>\u00een 2023 sunt <strong>Alexandru Ambrozie<\/strong> (60 de dosare de conciliere), <strong>Mihaela Budi\u0219teanu<\/strong> (59de dosare) \u0219i <strong>Valentin Cocean <\/strong>(59 de dosare).<\/p>\n\n\n\n<p>Peste <strong>11,3 milioane de euro<\/strong> reprezint\u0103 suma total\u0103 a beneficiilor ob\u021binute de consumatori \u00een urma negocierilor purtate \u00eentre 2016-2023 \u00een cadrul CSALB. &nbsp;Cea mai mare sum\u0103 rezultat\u0103 din negocieri s-a \u00eenregistrat anul trecut (3,3 milioane euro), cu peste 60% mai mare dec\u00e2t \u00een 2022.<\/p>\n\n\n\n<p>\u00cen medie, <strong>un consumator a ob\u021binut beneficii de 5.000 de euro<\/strong> dintr-o negociere purtat\u0103 anul trecut. De altfel, beneficiile de p\u00e2n\u0103 \u00een 5.000 de euro reprezint\u0103 jum\u0103tate dintre \u00een\u021belegerile intermediate de CSALB. Sumele reprezint\u0103 diminu\u0103ri ale costului creditului prin: reducerea sau eliminarea unor comisoane, diminuarea dob\u00e2nzii, sc\u0103derea ratelor \u0219i chiar \u0219tergerea \u00eentregii datorii (\u00een cazuri dificile).<\/p>\n\n\n\n<p>Peste <strong>500 de procese<\/strong> purtate \u00een instan\u021bele din Rom\u00e2nia <strong>au fost solu\u021bionate amiabil<\/strong> \u00een ultimii trei ani, \u00een cadrul CSALB. B\u0103ncile \u0219i judec\u0103torii au propus consumatorilor solu\u021bionarea alternativ\u0103, prin conciliere, de la primul termen de judecat\u0103.<\/p>\n\n\n\n<p>Astfel, consumatorii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>au redus timpul \u00een care \u0219i-au rezolvat problema (de la c\u00e2\u021biva ani \u00een instan\u021b\u0103, la o medie de 30 de zile \u00een ultimii ani, \u00een cadrul CSALB);<\/li>\n\n\n\n<li>au beneficiat de gratuitatea concilierii pentru persoanele fizice, \u00een schimbul cheltuielilor pe care le implic\u0103 un proces.<\/li>\n<\/ul>\n\n\n\n<p><strong>Alexandru P\u0103unescu, reprezentantul B\u0103ncii Na\u021bionale a Rom\u00e2niei \u00een Colegiul de Coordonare al CSALB: <\/strong><em>\u201eNe afl\u0103m \u00een al 8-lea an de conciliere a rela\u021biei dintre consumatori \u0219i b\u0103nci\/IFN-uri, iar cre\u0219terea activit\u0103\u021bii de la un an la altul demonstreaz\u0103 \u00eembun\u0103t\u0103\u021birea continu\u0103 a mecanismului de negociere condus de conciliatorii CSALB \u0219i disponibilitatea mai mare a b\u0103ncilor de a rezolva problemele \u00eent\u00e2mpinate de consumatori. \u00cen plus, cre\u0219terea num\u0103rului de procese \u00een care p\u0103r\u021bile doresc o rezolvare amiabil\u0103 confirm\u0103 principalul motiv&nbsp; al \u00eenfiin\u021b\u0103rii CSALB: acela de a le oferi consumatorilor \u0219i institu\u021biilor financiar-bancare o alternativ\u0103 la instan\u021ba de judecat\u0103.<\/em><\/p>\n\n\n\n<p><em>Rom\u00e2nii&nbsp; \u00eembr\u0103\u021bi\u0219eaz\u0103 tot mai des aceast\u0103 solu\u021bie rapid\u0103 \u0219i f\u0103r\u0103 costuri pentru ei. Sunt multe cazuri \u00een care oamenii \u0219i-au rezolvat problema cu banca \u00een una sau dou\u0103 zile. Practic, dup\u0103 ce au petrecut c\u00e2teva minute complet\u00e2nd cererea pe site-ul CSALB, consumatorul a primit r\u0103spuns de la banc\u0103 \u00een aceea\u0219i zi. A urmat deschiderea unui dosar de conciliere, \u00een care conciliatorul a propus imediat o solu\u021bie. Aceasta a fost acceptat\u0103 de ambele p\u0103r\u021bi, iar cazul s-a \u00eencheiat c\u00e2teva ore mai t\u00e2rziu, dup\u0103 schimburi de emailuri \u0219i discu\u021bii telefonice. Aceast\u0103 deschidere \u0219i disponibilitate manifestat\u0103 de unele b\u0103nci comerciale contribuie la consolidarea \u00eencrederii \u00eentregului sistem bancar.<\/em><\/p>\n\n\n\n<p><em>Din p\u0103cate mai sunt b\u0103nci care resping o parte dintre cererile pe care le primesc de la propriii clien\u021bi, prin intermediul CSALB. \u00cen aceste circumstan\u021be, <strong>recomandarea noastr\u0103 reiterat\u0103 inclusiv pentru anul 2024<\/strong> este ca aceste institu\u021bii de credit <strong>s\u0103 evite ca astfel de spe\u021be s\u0103 ajung\u0103 \u00een instan\u021bele de judecat\u0103<\/strong>, \u00eencerc\u00e2nd solu\u021bionarea direct\u0103 a problemei consumatorului. Dac\u0103 solicitarea nu poate fi rezolvat\u0103 prin negociere direct\u0103 \u00eentre p\u0103r\u021bi, este de preferat ca aceasta s\u0103 fie solu\u021bionat\u0103 prin implicarea conciliatorilor CSALB, evit\u00e2ndu-se calea contencioas\u0103. Astfel, p\u0103r\u021bile aflate \u00een disput\u0103 ar economisi resurse de timp \u0219i bani, iar instan\u021bele publice s-ar degreva de procese lungi \u0219i dificile, \u00een care, la final, doar una dintre cele dou\u0103 p\u0103r\u021bi are de c\u00e2\u0219tigat, nu am\u00e2ndou\u0103 cum se \u00eent\u00e2mpl\u0103 \u00een conciliere<\/em><em>.<\/em><em>\u201d<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"840\" height=\"840\" src=\"https:\/\/magazinmr.ro\/wp-content\/uploads\/2024\/02\/Liviu-Fenoghen-Alexandru-Paunescu-Alina-Radu-840x840.jpg\" alt=\"\" class=\"wp-image-2158\"\/><\/figure>\n","protected":false},"excerpt":{"rendered":"<p>.
